TERMS AND CONDITIONS

Everything You Need to Know

Rights for Usage

As a condition to using the Platforms, you warrant that you

   (i) possess the legal authority to create a binding legal obligation,

   (ii) will use the Platforms by its Terms & Conditions and

   (iii) all information supplied by you is true, accurate, current and complete. We retain the right, at our sole discretion, to deny access to anyone to the platforms and the services we offer, at any time and for any reasons, including but not limited to this set of Terms & Conditions.

 

Intellectual Property

Users acknowledge that VIETCHARM owns all right, title and interest in all intellectual property rights, including all content, logos, product designs, trade names, trademarks and service marks, and any content, data, software, technology, tools or business methods used by VIETCHARM to develop, promote, market, sell, and distribute the Products (collectively the “VIETCHARM Intellectual Property”).

VIETCHARM does not accept commissions to create copyright works other than to agree to licence Design Works developed and selected by VIETCHARM for delivery to the Client. This overrides section 21(3) of the Copyright Act 1994 in accordance with section 21(4) of that Act(b).

The Client warrants that:

  1. It owns or is lawfully authorised to use any pre-existing Intellectual Property Rights in materials supplied by the Client to VIETCHARM; and

  2. VIETCHARM is fully entitled to use those materials without restriction, for the purposes of this Agreement; and

  3. It will ensure that the Design Works are not altered in any way, at any time, without prior written consent from VIETCHARM.

Any Intellection Property breach will result in the immediate termination of access to the Platforms. 

 

Scope of Terms

We may update or modify the terms of these Terms & Conditions without prior notice and your continued use of our Platforms after the changed Terms & Conditions take effect, you will be bound by the modified terms. In case you do not agree to all the terms in this Terms & Conditions and/or the changes, you should discontinue using the Platforms.

 

Privacy Policy 

VIETCHARM understands that privacy is important to you and is committed to complying with the National Privacy Principles (NPPs), which are contained in the Privacy Act 1988 (Privacy Act). The NPPs govern how organisations in the private sector handle ‘personal information (which is basically information that can identify you).

What information do we collect and how do we use it?

We collect and use your personal information so that we can do business with you, such as process your orders and/or requests for publications, send you our bulletins and newsletters, event notices, invitations, and registrations, disseminate our research, and any other activity that constitutes your engagement with VIETCHARM. The personal information we collect from you usually includes your name, title, organisation, postal address, email address and contact number/s. We do not collect your financial information. If at any time you no longer wish to receive all or some communications from us, please let us know.

Will your personal information be given to anyone else?

VIETCHARM does not sell, rent or trade personal information about you to or with third parties. In some circumstances, however, personal information may be disclosed outside VIETCHARM. For example, we may disclose it if:

  • we are required or permitted by law

  • disclosure is necessary to protect and defend the rights or property of VIETCHARM, or

  • we consider it necessary to do so in order to enforce or apply the terms of any agreements with you.

Payment

The payment process will be based on the agreement of each purchase. If we are unable to process your order for any reason, the deposit will be refunded. The balance of the Price is due on the date you collect your dress. No goods may be removed from the premises until full payment of the order has been fulfilled.

VIETCHARM is permitted to collect the invoiced amounts in the name of and on behalf of the Customer, provided nothing else has been explicitly stated in the Customer’s invoice. If claims must be paid by the User in AUD currency. A suitable conversion charge may apply.

The Customer must enter the correct payment information and update the details immediately in the event of changes. VIETCHARM can reject the payment method specified by the user. The user will be notified of the payment methods (Cash or Debit/Credit transfer) permitted for the respective service during the order process.

Prices

Due to the Shipping cost and Seasonal status, prices may change from the time of inquiry to confirmation. These prices specified by VIETCHARM may be subjected to special conditions, for example with regards to cancellation and the refunding of payments made. VIETCHARM reserves the right to correct and/or change the prices without prior written notice.

Requesting A Change To Your Order

Once an order is placed via phone, mail, fax or web, we are unable to change or cancel that order. Since it is impossible to predict when an order that has been mailed to us will arrive, we are unable to make any changes or cancellations to ANY orders mailed to us. Please always double-check your orders, especially the ones you mail, as you will still be charged even if you have made an error. We will not issue any credits or remakes under any circumstances for any errors the customer makes on an order.

Cancellation Policies

  • If we are unable to process your order for any reason, the deposit will be refunded.

  • For In-store, The Customers are required to check for any damages, or faculties on the product before completing the item. The Customer will be held responsible for any damages incurred after the product leaves our premises.

  • For Online, you can choose between a refund or exchange where purchasing items are faulty, have been wrongly described, or are different from what you purchased on the website.

  • A $25 cancellation fee per order applies to all cancelled pickup dresses. If your event is cancelled or you cancel your purchase, VIETCHARM will happily refund the purchasing amount minus the $25 cancellation fee. Cancellations must be advised 48 hours before the Pickup Booking start date before the item is collected by the customer or posted to the customer.

  • VIETCHARM does not offer refunds for any reason after you pick it up. Store credit or exchange only.

  • Non-refundable or exchange for Custom designs service.

  • No refund or exchange for Sale items of 25%OFF or more.

  • VIETCHARM reserves all rights to refuse any requests for variations submitted after the confirmation date.

  • VIETCHARM reserves the right to cancel the product/products at reasonable notice. Reasons for cancellation may include (but are not limited to) an item being unavailable due to an unexpected late return by the previous customer or damage to an item. In this case of a cancellation, The Service Provider offers a full refund, store credit or the option to exchange another item.

 

Return

  • Please note- colours that you see on your monitor can vary and may not be exact. We also manufacture items that can vary from dye lot to dye lot. 

 

Warranties

  • NO warranties, selling the goods “as is.” for “Sale Off products”. Buyer acknowledges that it has not relied on, and VIETCHARM has not made, any representations or warranties concerning the quality or condition of the Goods, and it is purchasing the Goods on an “as is” basis. VIETCHARM expressly disclaims all warranties, whether express or implied, including any implied warranty of merchantability or fitness.

  • YES, VIETCHARM provides warranties for normal-price products. VIETCHARM gives a 5-day limited warranty from the date of delivery that the Goods are in good condition and shall be free from substantive defects. The warranty does not apply to any Goods that are damaged due to the misuse, abuse or negligence of any party other than VIETCHARM.

 

Shipping Policies

Delivery

  • Standard processing for most products is approximately 5 to 15 business days plus shipping time in Australia. For the custom design, it will take at least 45 days plus the shipping time. (This is not a guaranteed time frame as certain circumstances may cause a longer delivery)

  • Standard delivery excludes INTERNATIONAL orders which could take up to an additional 4 weeks. Since Holidays tend to get busy, orders can take up to a week longer. We give you the option at check-out to choose how you would like your products shipped. Please Note- First class mail has no tracking and we will not be responsible for the non-delivery of items shipped but not received if sent first class mail. The days listed are transit times and do not include the time it takes to make & and process your order. We do offer Rush services which MUST be phoned in. Call us at 0449144568 to inquire.

Shipping

  • We make every effort to get your items to you quickly and efficiently. We asked that you please double-check your shipping address as additional shipping charges will apply if your package is returned to us for an invalid or incomplete address. Once an order is placed and in the warehouse for processing, we can not change the shipping information. Signatures are required on some packages, failure to sign can result in the package being returned to us. We will not be held responsible for incurring the fee on returned packages or for shipping the item back to you, so additional fees will apply. If you choose to wave the signature and have the package delivered when you are not home, it will be your responsibility to pay for the cost of remaking and reshipping the item. There are some occasions if you order more than one item they might be shipped separately and arrive to you at different times.

  • Since we have no control over the shipping carrier, if your item is damaged in the mail, please keep your damaged package so that we can file a claim. We also do not refund Rush or delivery fees for late deliveries due to acts of nature which include tornadoes, hurricanes, snow, ice storms etc...) If this happens, call us immediately for further instructions. We are not responsible for refunding shipping and handling charges. 

  • For the exchange items, it will be your responsibility to pay for the cost of returning and reshipping the item.

 

Right to Refusal and Termination of Contract & Service

VIETCHARM adopts a policy of refusal and/or termination, under appropriate circumstances at its sole discretion. Circumstances include conflict of interest, infringement of data rights, abuse of system data, products & and services, features and functions and can include the legal policies of the countries concerned. VIETCHARM may also at its sole discretion limit access to the Platforms and/or terminate the accounts of any Users who infringe any intellectual property rights of others, whether or not there is any repeat infringement. 

 

Security Interest.

The Client hereby grants to VIETCHARM a security interest in the Goods, until Buyer has paid VIETCHARM in full for the Goods. The Client shall sign and deliver to VIETCHARM any document needed to perfect the security interest in the Goods that VIETCHARM reasonably requests.

 

Cleaning

After post-purchasing, The Customer has full cleansing care of the product, the VIETCHARM does not have the responsibility for any method that results in permanent damages. Only for hiring, we will dry clean care before and after renting.

 

Rental Returns

Date and Time

Our rental is for 5 days. We recommend you pick up your order 1-2 days before the event to ensure you have plenty of time to get your perfect look.​

Your 5 days could look like:

  • Day 1: Retrieve the item and try it on 

  • Day 2: Prep for the big day

  • Day 3: Wear it (and work it) at your event

  • Day 4: Cleaning the dress

  • Day 5: Return your rental item to our boutique.

If there is a delay in returning the product, the Customer must contact VIETCHARM immediately. Depending on the circumstances, an additional fee may or may not be applied. A $25 cancellation fee per order applies to all cancelled pick-up items, which is effective starting the next day of the final return date.

If The Customer fails to return the rental item(s) within three (3) days of the provided return date without making an official statement, VIETCHARM will declare the rental item(s) non-returned and hold the whole 100% deposit that The Customer has already paid.

 

In-store returns

Regarding in-store item drop-off, The Customer is expected to return the item within the opening hours on the last day of return. If the return date falls on the day that The VIETCHARM’s store is closed, the next day will be the required return date.

An appointment must be booked to proceed with the review and evaluate the returned item and refund.

 

Post returns

The Customer is supposed to return the item within the opening hours on the last day of return for in-store item drop-off. The required return date would be the following day if the return date occurs on a day when VIETCHARM's shop is closed. To progress with the inspection and examination of the returned gown and refund, an appointment must be made.

Once delivery has been made to your nominated address you bear all responsibility for your product. If you have opted to have your product delivered to your work address of the mailroom, responsibility is passed to you as soon as the mailroom has signed for the product. A secure shipping address is highly recommended when placing your order. If an insecure shipping address is provided Vietcharm does not bear any responsibility for the product left unattended. If you are unavailable to receive the item VIETCHARM will not be held responsible for additional shipping delays or additional shipping charges passed on by the delivery service.

 

Fit Guarantee

For the rental dress, interstate customers or customers unable to try on dresses in-store are entitled to a Fit-Guarantee. If the item does not fit, VIETCHARM will provide

  • Store credit.

  • Choose a different size (if we have other sizes)

  • Refund

  • Change to other styles

 

We only provide a fit guarantee for customizing and purchasing items. For purchasing items: we will alternate and custom based on your measurement size. It will take 3-6 months in advance for custom and up to 1 month for alternating.

 

Photo Licensing

The Client agrees that subject to the rights and licenses granted herein, VIETCHARM is and will remain, the sole and exclusive owner of all rights, titles, and interests, throughout the world, to all product photos and any copies of the product photos. Except as expressly provided in this Agreement, VIETCHARM reserves all rights and licenses not expressly granted in this Agreement.

 

VIETCHARM can use your Photos as customer feedback in social media and marketing campaigns.
